Renault India Loses Lawsuit To A Duster Owner For Wrong Colour Of Car

After two years, a customer has won the case against Renault India after receiving his Duster in an incorrect exterior colour shade

A customer has won the court case against Renault India for delivering the wrong coloured Duster. Peta Watt booked a green Renault Duster back in 2017 but received an orange version instead, which has prompted him to file a court case against the company. After two years, the court has finally come to the final judgment that favours the customer’s side.

On September 23 2017, he paid for the booking at a Renault dealership at Whitefield, Bangalore. According to the dealer, his car had to be delivered in the next five days. On the supposition that he would receive the new SUV soon, he sold his then-car one day after the booking. Unfortunately, the next day, he was informed that the green Duster that he booked was sold to another customer. He was offered two options, to wait for the new green car to arrive or to pick another colour instead. However, as he was in need of a car for personal reason, he was compelled to take the latter. Of course, the new colour was never his first choice. Afterwards, he filed his case against Renault in the consumer court.

After two years, on April 26 2019, the consumer court came to the final judgment, according to which, Renault has to recall the old orange car and return a new green Duster to the customer. Alongside, the company will also have to pay the customer an amount of Rs. 10,000 to make amends for the customer’s distress over the misdelivery. Also, another Rs. 5,000 are required to be paid for litigation expenses. PetaWatt will receive a new green Duster with the full package, including insurance, add-on insurance, taxes like road tax and registration tax, along with delivery cost and standard accessories expense.

The win of the customer, in this case, is also the triumph for all customers as a whole, who deserve rightful and transparent trading, especially when it comes to purchasing a valuable asset like a car. It is also a warning sign for the dealerships and automakers to take the customer’s request seriously and do their job accordingly.
